p1ng Health Inc. designs and builds products and software services that track your (our customers / users) everyday activities as well as your active fitness activities to provide you insights into your activities, and to make it possible for you to use those insights to develop a more effective and efficient personal health regimen.

This privacy policy is provided for our users in the context of their End User License Agreement and Terms of Use,  and to any web site visitors, and applies to our all devices, software, applications, and website(s).

Our products and services provide you access to fitness data and insights so you can better understand how active you are, and ways by which you can improve your fitness strategy.

We are committed to respecting your privacy, and keeping your data safe: This is our Privacy pledge:

  • We will only collect data that is useful to improving p1ng’s services, and your experience.
  • We will be transparent about our data practices and will explain them in clear language;
  • We will use your data in the aggregate to provide you with analysis and insights.
  • We will always take the security of your data seriously, and active work to safeguard any and all personally identifying information.

This policy may change over time, as our products and services evolve. If any modifications substantially change your rights under this policy, we will send you an email where possible, and always provide notice on the site.

What Data Does p1ng Health Inc. Collect?

When you activate a p1ng Health Inc. device, (“Device”) you can use the device independently to simply track number of steps taken, and vertical distance traveled. Or, if you want to access the full set of information collected by your Device, you will need to download an install the p1ng software (“p1ng”) onto your Device(s) of choice. We provide access via username and password via iOS, Android, Mac and Windows OS software interfaces.

When you first install the software, and register your Device, you will be prompted to enter some contact information about yourself, as well as your age, height, weight and gender. We use this information to provide you notifications and calculated information such as caloric burn and distance traveled, as well as additional insights. Your personal data is stored locally, and also in our database, so that you can access the information from any platform you desire. Your personal information is maintained in a database separate from your performance data.

We will access your phone’s contact list for the purpose of letting you identify contacts that are p1ng Health Inc. users, and to allow you to create activity groups. For example you may want to organize a cycling group, and the activity group will make it easy for you to invite everyone in one step. We do not store your phone’s contact list, and it is deleted immediately after it is used for this purpose.

You can customize your p1ng experience setting alert notifications, personalizing your profile with photos, creating groups, and organizing activities via your login interface. Whenever you add this type of data, we collect it and store it with your other account information.

Whenever someone visits our website(s), we collect industry standard log data that records commonly available information about your visit, such as your IP address, browser type, operating system, the URL of the page that referred you, the different actions you performed, and the IP address from the pages you visited. We use this type of information to provide you with information that’s relevant to your location and to make sure the Site is working properly. We also collect data from cookies.

When you sync your Device, data about your activity is transferred from your Device to our servers. This data is stored and used to provide reporting and power the various the p1ng services. Each time a sync occurs, we also log data about the transmission. Some examples of the log data are the sync time and date, and the IP address used when syncing.

When you order product or services from us, we store your shipping address so we can process your order. We do not, however, view or store your credit card information. PayPal, our third-party payment processor, handles this.

If you contact p1ng Health Inc. for help, we will collect your name and any additional information you provide in your request and store it on our servers in order to provide you with the required customer support and service and to improve the p1ng Health Inc.

To help you, and your friends and associates take advantage of all our services, we let you add friends who are already p1ng users or invite friends who have not yet joined to your activity groups. You can add friends in several ways, such as by providing their email addresses, or from the contact list on your phone. When you share your friends’ contact information with us to add them as a friend, we will only use it for this purpose. We do not store your phone’s contact list.

How We Use Your Data

p1ng Health Inc. uses your data to provide you with the best wellness experience possible, and to continually improve our services, and the insights we provide you. Here are some examples:

  • Height, weight, gender and age is used to estimate the number of calories you burn, and additional insights.
  • Contact information is used to send you account notifications, and to inform you about new features or products we think you would be interested in.
  • Your non-personally identifying data is used for research to understand and improve p1ng Health Inc. products and services.
  • Logs and other data are used to troubleshoot p1ng Health Inc. services; detect and protect against error, fraud or other criminal activity.
  • Non-personally identifying data in the aggregate may be used for research purposes and to provide insights into trends; as well as for marketing and promotional use.
  • We use your data to troubleshoot the p1ng Health Inc. Service and or detect and protect against error, fraud or other abnormal activity.

What Data May be Shared With Third Parties?

We don’t sell any data that could identify you. We only share data about you when it is necessary to provide our services, or when you direct us to share it. We do use aggregated, but non-personally identifying information for various purposes, as referenced above.

Data That Could Identify You

Personally identifying information is data that includes your name, email address, phone number, or other data that could reasonably be linked back to you. We will only share this type of information under the following circumstances:

  • To provide you with service and order fulfillment and payment processing. These companies are obligated by contract to safeguard any information they receive from us.
  • In connection with the sale, merger, sale of assets or reorganization of our company, your information can be sold or transferred as part of that transaction as permitted by law. The protection promises in this Privacy Policy will apply to your data as transferred to the new entity.

Data That Does Not Identify You

p1ng Health Inc. may utilize or sell aggregated, non-personally identifying data that does not include your name, email, or telephone number with partners and the public in a variety of ways, such as by providing research or reports about health and fitness. When we utilize this information, we take legal and technical measures to ensure that the data does not identify you.

Data that You Direct Us to Share

You can direct us to share data with other parties. For example, you might authorize us to link your p1ng Health Inc. account via API with a third-party app, or direct us to share data with your employer as part of a wellness program. Once you direct us to share your data with a third party, that data is governed by the receiving third-party’s privacy policy. You can revoke your consent to share with the third party at any time.

p1ng Health Inc. Social Tools

p1ng Health Inc. will in the future provide you with many ways for you to share data with other p1ng users, such as via contests and challenges. When you interact with others in these ways, you will be displaying certain personal data based upon application requirements. Always check specific policies associated with any contest or challenge to understand what data will be visible to other participants. Any data you submit in connection with these activities will be treated in accordance with this Privacy Policy, unless the rules for those offers notes otherwise.

How To Edit or Modify Data

Any data that you provide to p1ng Health Inc. can be modified from your dashboard or preferences. If you remove data from your User Account, it will no longer appear to you or others who use the Service. Backups of the activity data will remain in association with your User Account and in our archive servers.

How To Deactivate Your p1ng Health Inc. Account

You can deactivate your p1ng Health Inc. account by contacting our support service.  When you do so, data that can identify you will be removed from the Service. Backup copies of this data will be removed from our server based upon an automated schedule, which means it may persist in our archive for a short period. p1ng Health Inc. may continue to use your non-personally identifying data.

How Does p1ng Health Inc. Keep My Data Safe?

p1ng Health Inc. uses a variety of technical and administrative security controls to maintain the security of your data. If you have a security-related concern, please contact Customer Support 

p1ng Health Inc. complies with the U.S. – EU Safe Harbor Framework and the U.S. – Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of personal information.

Social media tools, like widgets and plug-ins, may be used so you can share information from p1ng Health Inc. on other sites such Facebook and Twitter. These interactive mini-programs collect your IP address, record the pages you visit on p1ng Health Inc., and set cookies that will enable the widget to function properly. Does p1ng Health Inc. Honor “Do Not Track” Signals

Although we would like to honor the browsers set with a “Do Not Track” signal, we are currently unable to honor those signals.

Data Analytics:

We use Google Analytics and Optimizely analytics cookies allow us to see how you use our services so we can improve your experience. We encourage you to read the Google Privacy Policy. If you prefer to not have data reported by Google Analytics, you can install the Google Analytics Opt-out Browser Add- on. Likewise, you can read the Optimizely Privacy Policy and opt out.
